General Terms and Conditions Amsterdam Boat Experience B.V.

Flagship Amsterdam B.V., trading under the name Amsterdam Boat Experience,

registered with the Dutch Chamber of Commerce under number 74390767,

having its registered office at Leliegracht 50 D, Amsterdam.

In the event of any discrepancies between the Dutch and English versions of these General Terms and Conditions,

the Dutch version shall prevail.

ARTICLE 1 – DEFINITIONS

Amsterdam Boat Experience: Flagship Amsterdam B.V.

Charterer: any natural person or legal entity entering into an agreement.

Consumer: Charterer acting outside a profession or business.

Business Charterer: Charterer acting in the course of a profession or business.

Passengers: Charterer and other persons on board.

Services: provision of a manned vessel including skipper.

ARTICLE 2 – APPLICABILITY

These terms apply to all agreements.

Mandatory consumer protection laws apply where relevant.

ARTICLE 3 – SAFETY AND CONDUCT

Boarding and remaining on board is at own risk.

All skipper instructions must be followed.

Alcohol is permitted according to agreed packages.

The Charterer remains responsible for Passengers’ conduct.

ARTICLE 4 – CONCLUSION OF AGREEMENT

An agreement is concluded upon written or electronic confirmation.

ARTICLE 5 – PERFORMANCE

Amsterdam Boat Experience may deploy an equivalent vessel.

Late arrival does not affect payment obligations.

ARTICLE 6 – PRICES AND PAYMENT

All prices and rates are exclusive of VAT, unless explicitly stated otherwise.

Where prices are communicated inclusive of VAT, this will be clearly indicated.

ARTICLE 7 – CANCELLATION

Up to 8 weeks: free of charge

8–4 weeks: 25%

4–2 weeks: 50%

2 weeks–7 days: 75%

Less than 7 days: 100%

ARTICLE 8 – FORCE MAJEURE

In case of force majeure, no liability applies.

Business Charterers are not entitled to refunds.

ARTICLE 9 – LIABILITY

Liability is limited to intent or wilful recklessness.

Liability is capped at the insured amount.

ARTICLE 10 – IMAGE AND MEDIA

Passengers may take and publish photos and videos.

ARTICLE 11 – GOVERNING LAW AND JURISDICTION

Dutch law applies.

Disputes shall be submitted to the competent court in Amsterdam.
